There are many important issues in choosing new office space, from the allocated parking to the concierge provision but with one of my client paying £26,000 a year on their electricity bills to the landlord, utility provision should be on your checklist!

 Is the most important clause in your lease about utilities?

 
 

THERE IS AN IMPORTANT CLAUSE FOR YOUR SOLICITOR TO ENSURE IS FULLY EXPANDED IN ANY NEW OR RENEWED LEASE FOR YOUR PREMISES. IGNORE THIS CLAUSE AND YOUR COSTS COULD ROCKET.

When you have your solicitor read through a new lease for your premises, their concern for utilities is to confirm whose responsibility they are. Often this is stated as a single sentence. If they are the landlord’s responsibility then there are a number of important factors to consider.

1. Access – Are you able to view the energy bills? This is essential to confirm that the landlord is renewing contracts and getting the best price. A single clause stating your right to view utility bills and contracts is all you need.
2. Rates – Landlords can add a fee for handling utilities for their tenants. Expect to pay up to 10% but this needs stating clearly in the lease.
3. What is the landlords attitude towards contract renewal and best price? Would they benefit from Mr Moffitt helping them kill their tenant’s bills while making their life easier?

29th January: Before you sign a lease check if the utilities are charged via the landlord. If so, ask if the energy is on contract for proposed premises.

30th January: Supplier contacted client to change electricity meter to a smart meter. Client told me & I told supplier there was smart meter installed!
